1. About these terms
KochasKart is an India-focused retail storefront serving supported locations from Kochas, Rohtas, Bihar. References to “KochasKart”, “we”, “us” or “our” mean the seller identified on your invoice and on the Contact page. “You” means a visitor, account holder or customer.
By using the storefront or placing an order, you agree to these Terms and the policies linked from them. If a product page or checkout gives a product-specific condition, that condition applies in addition to these Terms. Mandatory rights under the Consumer Protection Act, 2019 and other applicable law continue to apply.
2. Eligibility and your account
- You must be legally capable of entering a contract. A minor may use the service only through a parent or lawful guardian.
- Provide accurate contact, address and payment information and keep it current.
- You are responsible for activity performed through your account or verified mobile session. Tell us promptly if you suspect unauthorised access.
- We may restrict an account where reasonably necessary to investigate fraud, abuse, security risks or repeated policy misuse, subject to applicable law.
3. Products, availability and pricing
We aim to describe products accurately. Colours and appearance may vary by device, and measurements are approximate unless stated otherwise. Availability can change before order confirmation.
Prices are in Indian rupees. The checkout shows the item price, discounts, applicable taxes included in or added to the price as displayed, and delivery charges before you place the order. MRP and packaged-commodity declarations are shown where applicable.
- If a material catalogue, stock or pricing error is discovered, we may contact you for instructions or cancel the affected item and refund the amount paid.
- A promotion is subject to its displayed dates, eligibility, stock, redemption limits and exclusions. Unless stated otherwise, promotions cannot be exchanged for cash.
4. Orders and acceptance
Submitting an order is your offer to buy. An automated receipt only confirms that we received the request. We accept the order when we issue an order confirmation or begin fulfilment, whichever occurs first.
We may reject or cancel an order for unavailable stock, an obvious error, an unserviceable address, failed payment or verification, suspected fraud, purchase-limit abuse, or a legal or safety reason. We will explain the outcome where reasonably possible and refund captured payment for cancelled items.
5. Payment, delivery and pickup
- Available payment methods, COD eligibility and any limits are shown at checkout.
- Online payments are processed by the payment provider displayed during checkout. We do not ask for or store your UPI PIN, card PIN or OTP.
- Delivery dates are estimates unless expressly confirmed as guaranteed. See the Shipping and Delivery Policy for attempts, delays and damaged shipments.
- For pickup, bring the order confirmation and requested identity or verification. Ownership and risk pass on completed delivery or handover, subject to your statutory remedies.
6. Cancellations, returns, refunds and warranty
Our Cancellation Policy, Returns, Replacements and Refunds Policy, and Warranty Policy form part of these Terms. Product-specific eligibility displayed before purchase also applies, but does not take away remedies required by law for defective, deficient, spurious, wrongly supplied or materially misdescribed goods.
7. Acceptable use and reviews
- Do not misuse the storefront, probe security, introduce malicious code, scrape at scale, impersonate another person or use the service for unlawful activity.
- Reviews must reflect genuine experience and must not contain unlawful, abusive, deceptive, private or infringing material.
- When you submit content, you allow us a non-exclusive, worldwide, royalty-free licence to host, reproduce and display it for operating and promoting the storefront. You keep ownership of your content.
- We may moderate or remove content for a documented policy or legal reason, without manipulating genuine customer sentiment.
8. Intellectual property and third parties
The storefront software, layout, original text, branding and original media belong to KochasKart or its licensors. Product names and manufacturer marks belong to their respective owners. You may use the storefront only for personal, lawful shopping unless we agree otherwise.
Third-party payment, map, delivery or communication services may have their own terms. We remain responsible for our obligations and do not use third-party terms to remove rights available to you under law.
9. Responsibility and events beyond control
To the extent permitted by law, neither party is responsible for indirect loss that was not reasonably foreseeable when the order was made. This does not exclude liability for fraud, wilful misconduct, personal injury caused by negligence, product liability, or any consumer right that cannot legally be limited.
A party is not responsible for delay caused by an event genuinely beyond reasonable control, but we will take reasonable steps to reduce disruption, update you and provide remedies required by law.
10. Governing law, concerns and changes
Indian law governs these Terms. Courts with lawful jurisdiction may hear disputes; this clause does not restrict your right to approach a competent Consumer Commission or another statutory authority.
Contact customer support first so we can try to resolve the issue. You may then use the process in our Grievance Redressal Policy. We may update these Terms prospectively. The version accepted for an order remains available for that transaction, while legal or security changes may apply as required.
